Terms of Use

The rules that apply when you browse this site, commission a project, or take part in one of our sessions. Please read them before you get in touch.

1. What this site covers

Sprouts Creative is an independent studio based in Cape Town. We work on brand identity, packaging, art direction, and content production for food, lifestyle, hospitality, and retail businesses. This page sets out the terms that govern your use of the site and the general conditions under which we take on work.

2. Using the website

The content on this site is provided for general information about our services and approach. We do our best to keep it accurate, but we do not guarantee that every page is free from errors or always up to date. You are welcome to share links to our pages, but you may not republish our text, images, or portfolio work without written permission.

3. Commissioning work

When you commission a project, the specific scope, deliverables, timeline, and fees are agreed in a separate proposal or contract. That document takes priority over these general terms. Until a proposal is signed and any agreed deposit is paid, no work is considered booked.

We are transparent about what is included in each project: number of concepts, rounds of revisions, file formats, and usage rights. If something is not listed in the proposal, assume it is not included and ask us before the work starts.

4. Your responsibilities

You are responsible for providing accurate information about your business, products, and brand history. This includes supplying any existing logos, fonts, or brand guidelines in good time. Delays in receiving materials may shift the agreed schedule.

If you are commissioning packaging or label design, you are responsible for checking that the final files meet the requirements of your printer or manufacturer. We can advise on common specifications, but we do not guarantee that a particular production process will accept the files without adjustments.

5. Our responsibility

We take care to deliver work that is original and created specifically for your project. To the extent permitted by law, our total liability for any claim related to a project is limited to the amount you paid for that project. We are not liable for indirect losses, such as lost profits or business interruption, even if we were advised of the possibility.

We do not guarantee specific business outcomes. A new identity or a content calendar can support your marketing, but results depend on many factors outside our control, including your own execution and market conditions.

6. Intellectual property

Until the final invoice for a project is paid in full, we retain ownership of all working files and final deliverables. Once payment is complete, ownership of the final designs transfers to you for the agreed usage. We may keep copies of the work in our portfolio unless we agree otherwise in writing.

Any third-party assets, such as stock photography or licensed fonts, remain the property of their respective owners and are licensed to you as part of the project where applicable.

7. Portfolio review sessions and intensives

Our monthly portfolio reviews are informal feedback sessions for junior designers. They are not job interviews and do not guarantee any future work with us. The two-day branding intensive is an educational programme, not a consulting engagement. It gives you a framework for understanding the creative process, but it does not include the delivery of a finished brand identity.

8. Ending a project

Either party may end a project by giving written notice. If you cancel after work has started, you are responsible for payment for the work completed up to that point. If we end a project because of a breach of these terms or the project agreement, we will invoice for work completed and return any materials you have provided.

9. Changes to these terms

We may update this page from time to time to reflect how we work or to meet legal requirements. The version published here is the one that applies when you use the site. Significant changes will be noted at the top of this page.

10. Contact

If you have questions about these terms, a project agreement, or anything else, email us at info@sproutscreative.com or call +27(28)9271326.
